Introduction of Part II – Citizenship

Part II (Articles 5 to 11) if of our Constitution deals with the matters of citizenship. A citizen of a state is a person who enjoys full civil and political rights. India has two kinds of persons living in the country namely Citizenship and Aliens.

Article 6 – Rights of citizenship of certain persons who have migrated to India from Pakistan.

A person who migrated to India from Pakistan, if he or either of his parents or his grandparents was born in undivided India along with fulfilled anyone of the two conditions

  • if he migrated to India before 19th July, 1948 he had been ordinarily resident in India, since the date of his migration.
  • if he migrated to India on or after 19th July 1948, he had been registered as a citizen of India, But, a person could be so registered only if he had been resident of India for six months preceding the date of his application of registration.
