Introduction of Part 1

  • Dr. BR. Ambedkar explained the significance of the term union,
  1. Indian union is not a result of agreement of independent and sovereign states
  2. The union/states do not have right to break away from the Indian Union.
  • Part 1 of the Indian constitution contains articles 1 – 4 specifies the provisions related to the union and its territory

ADMISSION OR ESTABLISHMENT OF NEW STATES – Article 2

  • Parliament may be law to admit new states in the union and establish new states on such terms and conditions as it thinks fit
  1. Admission of states in India, which are duly formed and established and already in existence.
  2. Admission and formation of new states, which was not in existence before.
  • India passed 35th Amendment Act, 1974 which inserted new article 2A by which Sikkim became a associate state of Indian Union. Parliament made 36th Amendment act,1975 and Sikkim became 22nd state of Indian Union.
